Henry Reynolds: Australia was founded on a hypocrisy that haunts us to this day

US slave owners wrote and spoke about liberty, equality and the pursuit of happiness. Similar hypocrisy, buried in the foundations of settler Australia, has escaped comparable scrutiny.
The nature of the early settlements is so well known that it is frequently taken for granted. But for the first 50 years New South Wales and Van Diemen’s Land were, above all else, places for the punishment by transportation, of property theft. Local courts also handed out severe punishment for theft. In many ways the sanctity of private property rivalled the sanctity of life itself.
This was all done in accordance with the common law as it operated at the time. This law struck a balance between the Commons (the British people) and the Crown.
The 17th-century jurist Sir Christopher Yelverton explained
…that no man’s property can legally be taken from him or invaded by the direct act or command of the sovereign [ie. the King], without the consent of the subject … is a jus indigene, an old home born truth, declared true by diverse statutes of the realm
The laws with which the colony was founded also declared that Aboriginal people became subjects of the Crown, which should have given them protection under British law. This created a problem of timing. Did the British seize the land of Aboriginal people before Aboriginal people became Crown subjects? Some law experts have suggested this may have been the case.
In the High Court in 1913 Justice Isaacs explained how he saw the situation:
So we start with the unquestionable position that, when Governor Phillip received his first Commission from King George III on 12th October 1786 the whole of the lands of Australia were already in law the property of the King of England.
It seems more likely that the the great legal moment came when the British actually arrived at Sydney Cove and formally read the legal instruments on February 7, 1788. But this still does not explain how Aboriginal people became subjects and lost their land at the same time.

Algernon Talmage, The Founding of Australia. By Capt. Arthur Phillip R.N. Sydney Cove, Jan. 26th 1788. Oil sketch, 1939. Wikimedia

Who gave us the terra nullius myth?

The only judicial explanation for what happened was provided in a judgement in the little-known Privy Council case of Cooper v Stewart in 1889. The case found that at the time of first settlement, New South Wales was “a tract of territory, practically uninhabited, without settled inhabitants”. This was regarded as binding on Australian courts until the 1970s.
If that had indeed been the case then much of the continent would have been literally a terra nullius, a “nobody’s land”.
Why did the British think this? As it happens, this was the advice of Sir Joseph Banks, a man of power and influence – an aristocrat, President of the Royal Society and, even more importantly, a member of Cook’s expedition of 1770. In his writing and in evidence to Britain’s parliamentary committees, Banks declared that the long coast of eastern Australia was “thinly inhabited even to admiration”. As for the vast hinterland, of which he knew nothing, he said that it was almost certainly uninhabited.

Joseph Banks, painted by Joshua Reynolds, circa 1771-1773. Wikimedia

It seems a perfectly reasonable assumption that this advice had a decisive influence on both the decision to send an expedition to Botany Bay, and to justify a lack of recognition of Aboriginal sovereignty or property. This was a fundamental departure from well-established precedents in the North American colonies.
Throughout the 18th century the American colonial governments negotiated treaties with Native Americans, and this practice was carried on by the American republic after independence from Britain. In Canada, treaty-making continued until the early 20th century and has resumed in recent years. The underlying assumption was that indigenous peoples were landowners and also held a form of sovereignty.
The British decision to depart from this path in the settlement of New South Wales had disastrous consequences for the Australians, and predetermined much of the violence that characterised the outward spread of settlement for more than a century. The British imperial government carries a heavy burden of responsibility for the horrors that unfolded.
It may have been the result of the mistake of making fundamental and portentous decisions before the First Fleet had even set sail. But ignorance does not lighten the burden of responsibility. Clearly no convicts were ever excused by claiming their theft had all been a mistake and that they thought the stolen property in question belonged to no one.
More troubling is that it took Australian courts until the 1992 Mabo decision to provide some limited remediation, but not reparation, for one of the greatest land grabs in modern history.

The incurable flaw

There were people at the time who were troubled by the way the annexation had taken place. When Governor King was preparing to hand power over to his chosen successor William Bligh he provided him with notes to help with his orientation including the observation about the Aborigines and that he had “ever considered them the real proprietors of the soil.”
At much the same time in Britain the great political philosopher Jeremy Bentham wrote a pamphlet criticising the legal arrangements that had been made for the settlement of New South Wales. Among many points he made was the observation that there had been no negotiation with the Aborigines and no treaty had been signed with them. This created problems which would be enduring. “The flaw”, he declared, would be “an incurable one.”
Similar concerns about the conduct of the settlers, the fate of the Aboriginal people and the linked problems of property and sovereignty continued to be expressed across the generations by men and women who responded to the “whispering in their hearts” (a whispering first raised by Sydney barrister Richard Windeyer in 1842). They are part of the most enduring political debate in our history. They are still with us as Bentham predicted more than 200 years ago.
The problem is that there is no clear explanation in Australian legal theory to show how sovereignty passed from the first nations to the British crown. On this matter international law has been clear since the 18th century. Sovereignty can be lost and acquired either by conquest or by cession, that is, by the negotiation of a treaty. This was clearly understood by Bentham.
So what can be done? Ideally we should have a decision from the High Court. They could revisit the Mabo judgement and consider the question of sovereignty as Eddie Mabo himself wanted it settled. The case would be simpler than one which considered the actions of the British Imperial government. Murray Island was annexed by the Queensland colonial administration in 1879.
And if the High Court argues that it is unable to decide on such a question, the way forward may be an appeal to the International Court of Justice for an opinion on the matter. That would clear the way for treaty making in Australia itself which would finally provide a cure for Bentham’s flaw.

There is no valid government in Australia

IMG 6203 Canberra/Vaticanus
Parliamentary Precinct
The fundamental facts which give rise to the accuracy of the above statement are indeed simple and were succinctly stated a few years ago by the late Professor G. Clements (an eminent UK QC and emeritus Professor in law at Cambridge). He summed up the situation thus,
“The continued usage of the Australian Constitution Act (UK) by the Australian Governments and the judiciary is a confidence trick of monstrous proportions played upon the Australian people with the intent of maintaining power. It remains an Act of the United Kingdom. After joining the League of Nations in 1919 Australia became a sovereign nation. It had no further legal power to use, alter or otherwise tamper with another nation’s legislation. Authority over the Australian Constitution Act lies not with the Australian government nor with the Australian people, it rests solely with the UK. Only they have the authority to repeal this legislation …”.
Differing legal opinion cites the establishment of Australia as an independent sovereign nation over a wide range of dates. These include, but are not limited to:
1901
with the proclamation of the Commonwealth of Australia Act (Imp)
1919
with the signing of and unanimous vote by the Federal Parliament of the Commonwealth of Australia in acceptance of the Treaty of Versailles.
1926
by the declaration of the Inter-Imperial Relations Committee of the Imperial Conference.
1929
by the Balfour Declaration
1939
by the Federal Parliament of the Commonwealth of Australia enacting the Statute of Westminster Adoption Act 1942 (Cth) back dated to 1939.
1945
by the Commonwealth of Australia becoming a foundation member of the United Nations and subsequently enacting the Charter of the United Nations Act 1945.
1986
with the passing of the Australia Acts (both UK & Cth)
1917-1939-1986:
alternatively, the less controversial but flawed gradual evolution during the 20th century explanation.
Which ever date is chosen does not alter the consequences of the breach of Sovereignty, for Prof. O’Connell states:
“Whatever form the change in sovereignty may take it involves a disruption of the legal continuity… These rules form a body of doctrine known as the law of state succession…”
(International Law, P. D. O’Connell, Vol. 1, 2nd ed. 1970, p. 365-368)
However contrary to much of domestic Australian legal opinion, Australia became an independent sovereign nation following Mr. William Morris Hughes, Prime Minister and Commonwealth Attorney-General, together with Sir Joseph Cook, signing the multi-lateral Treaty of Peace at Versailles, France in June 1919. This included the Covenant of the League of Nations, along with many other important documents in International Law. Particular attention should be paid to clauses I, X, XVIII, and XX of the Covenant. go to ...The ‘Australian’ Constitution is United Kingdom law.

In “An Act to Constitute the Commonwealth of Australia”, the 9th clause of which is usually referred to as the ‘Australian Constitution’ was, is, and remains conditional upon the first 8 covering clauses of that Act, a current Act of domestic law of the United Kingdom Parliament.

Under Section 128 of Clause 9, minor alterations to the Constitution may be made by the Australian people. However, the Australian people may not alter, in any way, Clauses 1 to 8 of the Imperial Act. Since the Australian people have only ever had the right to change sections 1 to 128 of clause 9 of that Act, it follows that covering clauses 1 to 8 remain law in Australia.

The Commonwealth of Australia Constitution Act passed through the UK Parliament in June 1900, to commence as law in Australia on the 1st of January 1901. Since the people of Australia have only ever had the right to change Sections 1 to 128 of Clause 9 of this Act, it follows that covering clauses 2, 6 and 8 remain law in Australia. (See Joosse v ASIC HCA 1998 159 ALR 260 or go to http://www.austlii.edu.au/…/other/hca/trans…/1998/M35/1.html )

This means that British colonial law still operates in Australia and that Australia is a self governing colony of the United Kingdom as stated in that Act (see clause 8). However, the High Court of Australia has recently ruled that the United Kingdom is a foreign power, and that the UK Parliament cannot have any effect on the Governments of Australia (Sue v Hill HCA 30 of 1999 or seehttp://www.austlii.edu.au/au/cases/cth/high_ct/1999/30.html).

Hence, if British colonial law continues to operate in Australia, then this constitutes a clear breach of international law, along with the duties and responsibilities of the Australian and the United Kingdom governments, as both were Foundation Members to the League of Nations, and the United Nations. The Covenant and the Charter of both bodies, respectively, bind these nations.

The Australian people do not have ultimate control over the ‘Australian’ Constitution. In mid-July 1995 the Lord Chancellor of the UK in answer to a Parliamentary question asked in the UK Parliament about the Australian Constitution, stated:
“The British Constitution Act 1900 was for self government. It was never intended to be and is not suitable to be the basis for independence. The right to repeal this Act remains the sole prerogative of the United Kingdom. There is no means by which under United Kingdom or international law this power can be transferred to a foreign country or Member State of the United Nations. Indeed, the United Nations Charter precludes any such action”.

Sovereignty is in the spotlight, but for all the wrong reasons.

IMG 5136

Sovereignty has always been a notion spoken of because one has an understanding of what Natural Law entails and an understanding of who we are as human citizens on planet Earth.  Our responsibility to the planet is to take care of the planet for our future generations and this being one of the highest ideologies one should ever consider beside parenthood.

At present we are so screwed down as a society of free range slaves by legislation and the net just got tighter around the 'slave pen' with the government announcement on those that call themselves 'Sovereign Citizens'.

From the ABC Article

http://www.abc.net.au/news/2015-11-30/australias-sovereign-citizen-terrorism-threat/6981114
Anti-government extremists known as "sovereign citizens" have been identified as a potential terrorism threat in Australia by a confidential NSW Police report.
Below are some helpful videos to get your head around the mess the government are present preaching around this issue.  It is imperative to understand that we are being shafted once again and straight on the heels of the "No Jab No Pay" legislation.

And so there must be a good understanding of what Natural Law is and what it isn't.  It most certainly is not the peace love and brown rice a lot of New Age converts spurt.  Natural Law is very very different to this and one should be fully competent in what this entails.

Reading the Corpus Hermeticum and books such as the Kybalion will start you on a journey of understanding if you are not familiar already.  Watching videos by this gentleman Mark Passio can help one understand the intricacies at play here with this push against sovereignty by governments at a much higher level and understand the politicians are mere puppets.

Demonizing Sovereignty only servers to turn brother against brother once again.  Here in Australia there is a huge following for the Sovereign Nations of this land to be recognized for who they are in their own right, and I fear this will also be heaped in with the extremist views of those that are not aboriginal and don't have a reason to want to be recognized as sovereign on this land they have been on for 80.000 years plus.

It only stands to reason why the government is making this word a very dirty word now.  This is back door Genocide once again.  The lack of treaty with those that wish to remain sovereign is Genocide!

Where there is sovereignty, there is Anarchy and anarchy is nothing to be afraid of as it only means no rulers or the absence of a monarch [one ruler].   With the prefix 'An' being none or not, so, No Monarchy = Anarchy. ... from the Latin Archon - to rule which was borrowed from ancient Greek meaning magistrates there or rulers.

(Gnosticism) A supernatural being subordinate to the Demiurge.

and....

"The Natural Liberty of man is to be free from any superior power on Earth, and not to be under the will or legislative authority of Man, but only to have the Law of Nature for his rule"  John Locke

Warriors of the Aboriginal Resistance...

Brisbane City
Last Friday night there was a rally at King George Square and  members of the Brisbane Aboriginal  Sovereign Embassy and the Brisbane Warriors of the Aboriginal Resistance movement shut down the city in protest of the shutting of 150 Aboriginal Communities and the turning off of essential services to those communities forcing the people into already over crowded troubled large townships where violence and addiction are rife and services are already stretched to breaking point.

The City of Brisbane is one of my favorite cities of Australia.  I grew up there in my teenage years and went to school and was kept by the government in their dodgy children's homes as a child in government care there.  I know what the government are capable of and I have never stopped trying to tell others.

Sadly, most thought I was just being vindictive about my upbringing and was just whinging.  They could not have been further from the truth.

I used to say years ago before getting certified with my Community Services Welfare Cert IV that the system that is here we think is in place to protect us is not real.   It is a figment of our imagination and Lord help us if we ever have to test the system.  By the time we have to test it, it will all be too late to do anything because its just not ever really been there.

This is where we are at today in our screwed society.  This is what is happening to both the black and white communities and all in between.  Everyone is being hammered by warped government policy and its a facsist neo liberalism at its best because both the corporations and the Government are playing hand in hand.   The corporations are getting the privileges which are the peoples birth rights.

The basics card, Children's Services stealing children, Closing Communities, Trashing sacred areas, Disconnecting Families, Low Income bashing,  all of this is not a mistake.  This policy was planned a very long time ago like all of the government strategies are.   There are advisers working overtime to work out ways to use and abuse the general public and dress it up so as the poison is no longer detectable in their genocidal policies.  Steal the children and brain wash them to their way of thinking and you have a powerful movement of people disconnected from truth who think they are doing the right thing and going on thoroughly unawares.

Hundreds of police were present through the walk through the city streets after we left the square and absolutely no media were present anywhere.

All that ruckus and no media and we shut down the center of Brisbane for approximately two hours  through the streets of Adelaide, Edward, Anne, George and Queen Streets and then we stopped the traffic on the Captain Cook Bridge.

No one wants to have to go to these measures or even upset others.  I simply have to do what is right and tell others who have a right to know this is happening in Australia.  Somehow it helps the pain of my past wrongs if I save others from feeling how I have felt.   I send love to all who are struggling through this.

We are trying to brain storm ideas to help.  Solar power and humidifier statues were a suggestion.  Now to make that a reality.

Why An Embassy In Our Own Land?

Definition: An embassy is an outpost on foreign soil usually, offering security and diplomatic asylum; a body of persons entrusted with a mission to a sovereign or government.

Arising from a growing sense of alienation – a belief that Aboriginal people had, effectively, been made foreigners in our own land – an embassy was launched in Canberra on 26 January 1972 (Australia/Invasion Day). At first literally a tent and later a shed, the embassy is located near the front steps of what was then Parliament House (now known as Old Parliament House).

The Aboriginal Tent Embassy is a national icon for the Aboriginal sovereignty movement, which has consistently challenged the legitimacy of the sovereignty of the colonial regime. This January on the 40th anniversary of the embassy in Canberra Aboriginal people from across the country gathered and decided to further our campaign for sovereignty by setting up embassies across the land.

Like other sovereign embassies, the Brisbane Sovereign Embassy seeks to raise awareness and discussion of Aboriginal sovereignty, provide sanctuary for Aboriginal people and a place for cultural, spiritual and ceremonial activity,
focused on the sacred fire and circle that have been established as part of the embassy.

What is Sovereignty?

Definition: Sovereignty is the law of the land and the power to use it - the legitimate power to govern. If we had our law in practice when we were invaded, our law is the law of the land until conquered in war or treaties signed.

Sovereignty can be an important building block for the right of peoples to self-determination. In the international system of states, these principles of self-determination and independence form the basis of international relations and international law.

Always was, always will be Aboriginal land!

On the 22nd August 1770, Captain James Cook planted a foreign flag on an Island belonging to Aboriginal nations, now called Possession Island, taking illegal possession of our lands and its resources, without the permission or knowledge of any Aboriginal people.

Aboriginal activist and lawyer Michael Anderson says a recent appeal court decision implies that Australian courts have no jurisdiction over Aboriginal
people because they have never given up their sovereignty, that there had never been a defeat in a declared war, that Aboriginal land had not been ceded and that the British crown had not asserted sovereignty over Aboriginal people. In fact, Queen Victoria made it illegal for agents of the to crown to claim sovereignty over Aboriginal people and their lands in the Pacific Islander Protection Act, 1875. Even under their own legal system, the Australian and
State Governments have no legitimate claim of sovereignty over this land.

Aboriginal and Torres Strait Islander Peoples continue to maintain, to this day, their sacred, spiritual, social, political and economic connections to their lands since time immemorial.

A new society

By asserting and struggling for Aboriginal sovereignty, we are not just righting the long standing injustice against Aboriginal people. Sovereignty provides a chance for all who live on this land to build a new society based on Aboriginal culture and values. A society ruled by social need and environmental sustainability, not one of greed and discrimination. A unique society with a definative system of laws and customs to govern it, based on the world’s oldest living culture, that will allow Australia to proudly take its place on the world stage for the first time in history.

According to our information the meeting is taking place on Monday 6th July at Kirribilli House where there is considerable security. What Abbott and Shorten are doing with this conference is making a mockery of the diplomatic processes they espouse in Australia.

It is not possible to conduct a successful plebiscite if the whole process is camouflaged and hidden from the public. Then to restrict the participation in something of this magnitude is criminal. We expect this in countries where people are governed by dictators, but then are Australians really comfortable with the Abbott government's governance?

The Recognise campaign is trying to subvert the Aboriginal sovereignty movement.

So if you think im racist LOL because I dont agree with RECOGNIZE then educate yourself and shut the hell up with the garbage politician Side of the story.. politicians spread lies = its their job .. fkd job but yep that is their job description ---> spreading lies and deceit disguised as truth to the sheep who listen.

The Roman Empire tried to pacify conquered peoples by giving out cheap food and entertainment (superficial means of appeasement), hence the phrase “bread and circuses”.

This tactic was intended to create public approval through diversion and distraction.  How is Constitutional reform any different?

Babakiueria from back in 1986

Satirical comedy.  This was put out in 1986 by a group of Redfern people.   They were sharp as tacks about the truth of what was the truth.

It took a while before a larger percentage woke up and now lots more people see the theft and the genocide that went on undocumented.  So many more folks speaking out and who are ashamed to be called Australian's because of such a dark and dreadful history.   - some of which is surfacing  now.  The treatment of children in institutions,  ripped from the arms of their mothers who were told they were going to a better life.  Instead,  they were brutalized and sexually abused and treated so badly it can hardly ever be excused.  The Church and the Government worked hand in hand to instigate this brutality.

The brutal genocide is ongoing and we are experiencing a third wave of definitive genocidal practices that are designed in a back handed way to eliminate cultural diversity.  (closing communities) (turning off water supply) (forced intervention).  Northern Territory government is a puppet government for the Federal System.  Their so called open gate to Indonesia.

Synopsis

A satire of the theft of this land by the British colonizers in 1770.  The script follows the plan to fully turn everything around the other way.  This is done to point out the blatant theft and the genocidal practices carried out on the first people of this land who did not invite this war nor did they consent to treatise.

Theft will always  be theft and until the truth is revealed regarding the white man's own law saying what they themselves have done is actually theft.
Babakiueria is named as a result of first contact between the coloniser's and the natives. Arriving at a barbecue area, the settlers ask the locals, ‘What’s this place called?’

Presenter Duranga Manika (Michelle Torres) looks back at this moment and at white people’s place in contemporary Babakiuerian society. She also spends time with a ‘typical’ white family.  Australian Screen

Tomorrow, the country blindly celebrates Australia Day.  This day is  an extremely sad day for the first peoples of the land.

The Australia Day / Invasion Day Celebration begin once again for 2015.  I will never forgive such a blind government that refuses to at least change the date of this b.s. national celebration of death .

They ought to be ashamed to call themselves leaders.  Politicians who are happy to continue to perform such contrived acts of  pain against the original people whose ancestors were brutalized for the sake of the colonists.  It must stop.

So what if I think Murrumu is a hero?

MURRUMU ....Murrumu Walubara Yidindji, as he is now, is highly adept with words – consistent with the reputation he honed in Canberra and elsewhere (among other stories he broke, Murrumu was the first western reporter to interview Julian Assange in London’s Ecuadorian embassy) as a highly respected journalist. He footnotes his English aphorism with Latin interpretation and constantly riffs – even kind of raps – off the entendre of words he so precisely selects. Guardian
I first read about what Murrumu did a couple of weeks back and my first thought was that this man was a veritable real life hero for his people and for many others who share his point of view on this subject of Australia and of the facts of all of our Citizenship.

I liked how Murrumu penned it Citizen Ship, like a ship he was alighting from.  I read through all of this with such excitement that this man had courage to burn.  It is being true to what we all preach and how could anyone fault him for this.

Read the entire story here at the Guardian explaining why Murrumu did this.

I thought it was interesting from the fact of Admiralty Law.  Our law in this country is false law because we are under a false system from the English Trone (Monarchy)  We are one her Vassals and for what its worth we should not be such because No One said so.  Nobody said it was cool and this is their rules (British).  So much for fair play.

So Murrumu handed everything back to the appropriate peoples, his passport, Medicare, Superannuation of twenty years, all bank accounts and any property he owned.  He surrendered the lot and wrote  letters to accompany these items back to the government departments.

He lives on trust now and that is a big thing, but the biggest shock to me was to wake up to find that Murrumu had been arrested by Federal Police.

This is going to get interesting because he was released the next day by a magistrate.  He was freed on No Bail.  So we sit and wait to see where this avenue turns into a highway we can all traverse.

IMG 6969.1
Everything is played out in the spirit realm first.

So they lock him up for three days on the Public Purse and try to pursue this in court and the Magistrate Boss is not impressed by any of it.  She warns Gavin Mansfield, the Prosecution that they should be very wary of pursuing such matters and they had better be well prepared for such a case.

The audacity of the Prosecution in this matter is evident as they asked for a relatively soon re convention back to court and a date of the 16th February was set down.

Out side the Court Murrumu spoke of the laws being not there to have this heard in court because he was not a citizen of this land and that this will cause them more problems than him.  Read the transcript from the Guardian regarding his interesting day in court.  It is HISTORY MAKING in my opinion.
